The University Committee of the University of Wisconsin-Parkside met Tuesday, February 28, 2006 in the Governance office. The meeting was called to order at 3:35 P.M. by Doug DeVinny, chair. Also attending were members Chris Evans, Fran Kavenik, Mary Lenard, Dennis Rome, and Anne Statham. Greg Mayer was guest of the Committee, and Walter Feldt and Evelyn Zepp were present as Transitioning Secretaries of the Faculty.
1) There were no minutes of the last meeting.
2) Unfinished Business:
a) The Faculty Preference Survey will go out before Spring Break.
b) The Academic Staff Preference Survey will go out after Spring Break.
3) New Business
a) Agenda for the Senate meeting of March 21, 2006. After discussion, the order of matters to be taken up at the Senate meeting was established:

Discussion (perhaps in Committee of the Whole): Proposed UWS 7
b) Discussion of proposed UWS 7 (discussion led by guest Prof. Mayer):
--Prepare a short draft resolution followed by bulleted talking points/background page
--Flaws in document:
* no connection between suspension and dismissal
* asks Provost and/or FRRC to take action prior to any action by the legal system
* not allowing due process (in suspension)
* dismissal should only be after a conviction
* Wis. Statutes Section 113 does not allow discrimination in employment because of a criminal conviction unless the crime is substantially related to the position
("seriously impairs the public trust in the university"--7.02 (b)--does not meet this standard)
* argument to support UWS 7 may be that actions would be administrative and not criminal
* UWS 7.02 (c) (2) is the Safransky standard
* 7.04 requires self-incrimination
* 7.01 is reasonable and could be endorsed in the resolution
* 7.05 expedites the process of UWS 6, should only be evoked by actual conviction
* there is a change in the burden of proof from UWS 6
* the Provost would overrule the FRRC
* reasonable grounds for suspension--charged vs. indicted
* back pay if cleared--would have to go with what general law is
--Prof. Mayer will prepare the draft resolution and background
